RPG Law: Recent Case Results

The following is a list of representative cases recently resolved by RPG’s Litigation Group:

1) RPG recently represented a condominium association on appeal before Florida’s Second District Court. RPG challenged the trial court’s determination that the community’s boat docks constitute appurtenances to the units. RPG’s client ultimately prevailed on appeal and the trial court’s order was reversed.

2) RPG recently settled a breach of contract / construction defect case filed against a national construction company. The construction company initially offered $150,000.00 to settle the case at mediation, but ultimately increased its offer to $400,000.00 prior to trial.

3) RPG recently obtained an injunction against a unit-owner requiring the owner to remove a disruptive occupant from his condominium unit. RPG also recovered all legal fees and costs from the offending unit-owner (>$30,000.00).

4) RPG obtained final judgment against a unit-owner requiring her to reduce the size of her paver patio in accordance with the community’s governing documents. The unit-owner subsequently filed an appeal, but the Appellate Court affirmed the trial court’s ruling. The Firm’s client obtained a judgment for its legal fees and costs, to include legal fees and costs incurred on appeal.
