Construction Defect Litigation
The firm's condominium association client hired a national contractor who walked off the job after significant construction defects were discovered mid-project. After initially receiving settlement offers in the five-figures, the Association ultimately recovered $400k in compensation prior to trial.
RPG obtained a favorable trial verdict against a unit owner who encroached upon and altered the common elements. The condominium association was also awarded prevailing party attorneys' fees.
Developer Turnover Litigation
Turnover / Developer Claims (construction defects): In an arbitration case filed against one of the nation's largest homebuilders, RPG obtained a $500k+ settlement on behalf of its HOA client. The developer-builder initially offered a low five-figure settlement prior to our involvement.
A local municipality filed suit against the firm's HOA client seeking to annex HOA property. Following a two-day trial and a subsequent appeal, the firm's client prevailed.

Insurance Coverage Dispute - Duty to Defend
Following a denial of coverage, the firm successfully obtained a favorable insurance coverage determination (a reversal) after filing a civil remedy notice. The firm also recovered attorneys’ fees and costs from the insurance carrier.
The firm successfully secured an emergency temporary injunction requiring a unit owner to vacate the condominium property as a result of that owner's ongoing, egregious behavior.
Construction Defect Litigation
RPG successfully obtained a six-figure judgment against a roofing contractor on behalf of the firm's condominium association client (the contractor's subsequent appeal was dismissed by Florida's Second District Court).
The firm, on behalf of its client, prevailed on appeal before Florida's Second District Court in a case where multiple unit owners filed suit seeking to dissolve a multi-condominium. The firm's client was awarded and recovered its prevailing party attorneys' fees and costs.

Construction Defect Litigation
After the association's prior legal counsel suggested that they did not have a viable case, the association retained RPG to file suit on their behalf against a roofing contractor. The contractor ended up paying the association $90,000.00 to settle the case prior to trial.
The firm successfully secured a temporary injunction against two unit-owners who were engaging in short-term (AirBnB) leasing. The Association recovered attorneys' fees and costs from the owners.
