Rabin Parker Gurley, P.A. Secures $90,000 Settlement on Behalf of Condominium Association Client in Construction Defect (Roofing) Case

Pinellas County Condominium Association Holds Roofing Contractor Accountable:

A condominium association located in Pinellas County retained a roofing contractor to install a new roofing system on three condominium buildings within the community. As is all too often the case, the community’s residents noticed water leaking into the buildings shortly after the contractor finished the project. When the Board approached their prior legal counsel for guidance, they were told they should not bother bringing legal action against the contractor. The Board subsequently engaged our law firm.

Upon being retained, our firm notified the contractor of the defects at issue in accordance with Chapter 558 of the Florida Statutes. Thereafter, when the contractor declined to accept responsibility for the defects and resulting damage, our office (on behalf of the Association) filed suit for monetary damages. Faced with a lawsuit, the roofing contractor ultimately agreed to pay the Association $90,000.00 to settle the claim short of trial.

If your community is dealing with construction defects, we would be happy to meet with your board of directors to discuss potential legal remedies. Please contact our office at 727.475.5535 to schedule a meeting.
