As of July 1, 2025, Florida law tightened the rules for condominium associations when it comes to affidavits. If you’re not sure what needs to be maintained or posted online—don’t worry, you’re not alone.
Here’s what you need to know in plain English:
What’s Changing?
Florida law already requires condo associations to keep certain affidavits as official records. The new changes (CS/CS/HB 913) go further:
If your association has 150+ units (by July 2025) or 25+ units (by Jan 2026), you must also post these affidavits on your website within 30 days of creating them.
This helps owners see that required notices and reports were properly delivered—no guesswork involved.
Which Affidavits Are We Talking About?
Notice of Special Assessments or Rule Changes
(s. 718.112(2)(c)): Proof you gave proper 14-day notice for non-emergency assessments or rule changes.
• Notice of Annual Meetings & Elections
(s. 718.112(2)(d)): Often called the “14-day notice affidavit.” Shows owners received timely notice of annual meetings.
• Financial Report Delivery
(s. 718.111(13)): Sworn statement confirming owners received the annual financial report on time.
• SIRS Receipt
(s. 718.112(2)(g)): Each board member must sign an affidavit acknowledging receipt of the Structural Integrity Reserve Study.
• Lien & Foreclosure Notices
(s. 718.116 & s. 718.121): Sworn affidavits proving that delinquency notices were properly mailed.
• Declaration Amendments
(s. 718.104 & s. 718.110): Requires formal, signed certifications when making changes to the governing documents.
