Effective Strategy to Address Short-Term Leasing

Many clients struggle to enforce their community’s short-term leasing restrictions. All too often, owners allege that the individuals residing in their unit are (non-paying) guests, rather than tenants, and the association is left to try to prove otherwise – which can be a challenging task.

Consider adopting an amendment that prohibits owners from advertising their unit as a short-term rental. By doing so, you may be spared from having to prove that the occupant is tenant rather than a guest since the mere advertising of the unit for rent on a short-term basis (on Airbnb, Vrbo, etc.) would constitute a violation.
