We are certain you have been inundated with mail regarding this extraordinary virus. However, we wanted to take a moment to address a few common concerns raised by our community association clients.
Our office, along with many other practitioners in the State of Florida, are advising clients as follows:
1. We encourage boards to consider postponing any major or controversial decisions until it is safe for members to again congregate in large numbers so that the members have an opportunity to voice their opinion on agenda items.
2. Where it is necessary to address major or controversial decisions, we encourage boards to consider use of available technology which would permit live broadcast of its meetings to the constituent membership so as to permit membership participation in real time.
3. Finally, consider passing a temporary rule (or amending an existing rule) to address use of the common amenities in your community, such as a clubhouse, swimming pool, or other area generally shared in close proximity with others.
